Property Manager Terms & Conditions
The purchase, use and receipt of any product or service provided by Property Manager Ltd constitutes your acceptance of these Terms and Conditions and agreement to abide by them.
This Property Manager Agreement (the "Agreement") is a legal agreement between you (either an individual or a single entity), the end user, and Property Manager Limited, for the use of the Property Manager software or the Property Manager Business Pack (the "Software"). The Software also includes any updates and supplements to the original Software provided to you by Property Manager Limited. Your rights to use the Software are limited by the terms and conditions of the Agreement below. The permission of Property Manager Limited, to install the Software is expressly conditioned on your reading and agreeing to the Agreement in its entirety before installing the Software.
Copyright: The Software is owned by Property Manager Limited, and is protected by copyright laws and international copyright treaties. While Property Manager Limited continues to own the Software, you will have certain rights to use the Software, following your acceptance of the Agreement. Your rights and obligations with respect to the use of this Software are as follows:
Grant of License:
Single User License
You may use one copy of the Property Manager Software on one computer. You may also place the Software on a network server, provided it is used only to install or run the Software on one computer over an internal network. You may physically transfer the Software from one computer to another provided that following the transfer the Software is removed from one of the computers in its entirety.
Business Pack Single User License
One copy of the Business Pack is required for each PC that will use the Business Pack. You may also place the Software on a network server, provided it is used only to install or run the Software on one computers over an internal network. You may physically transfer the Software from one computer to another provided that following the transfer the Software is removed from one of the computers in its entirety.
You may not rent, lend, lease, or sublicense any portion of the Software; make copies of the documentation which accompanies the Software; translate, reverse engineer, decompile, disassemble, alter or modify the Software, or; create any derivative works based on the Software or accompanying materials.
All rights not expressly granted are reserved by Property Manager Limited.
In the event of a customer purchasing Property Manager and deciding that they do not wish to use the software, Property Manager Limited will refund the original purchase amount provided that the activation code has not been provided.
In the event of a customer purchasing the Property Manager Business Pack, the customer will be entitled to a refund if the pack has not been downloaded from our web site or for postal orders, if the order has not been dispatched.
Limitation of Liabilities To the maximum extent permitted by applicable law, in no event shall Property Manager Limited or its suppliers be liable for any special, incidental, direct, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Software or the provision of or failure to provide Support Services. In any case, Property Manager Limited entire liability under any provision of this Agreement shall be limited to the greater of the amount actually paid by you for the Software or GBP.£5.00; Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
Entire Agreement: This Agreement is the entire Agreement between Property Manager Limited and you and supersedes all prior agreements, oral or written, for use of the Software. If any provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
